THCA Reaches Texas Rules Two Different Ways. Only One Is Settled.

Ask five people this week whether THCA is a problem in Texas and you will get five confident answers. The reason they conflict is not that four of those people are careless. It is that THCA reaches Texas rules by two separate routes, and an answer travelling down one route sounds like a complete answer to both.

One of those routes our review has verified against the primary source. The other it has not. This page keeps them apart.

Route one: THCA is part of the arithmetic

This one is settled, and it is the one you can act on.

The Texas consumable hemp threshold does not bind delta-9 THC on its own. It binds total delta-9 THC, at 0.3% or less on a dry weight basis, inclusive, with an allowance where the accredited laboratory's measurement of uncertainty produces a range that includes 0.3% or less.

Total delta-9 THC is a computed value:

> total delta-9 THC = delta-9 THC + (0.877 × THCA)

So THCA is not a separate question sitting beside the threshold. It is an input to the threshold. A certificate reporting a comfortable delta-9 number and no THCA figure has not shown you a passing result — it has shown you an incomplete one, because the number the rule actually binds cannot be derived from what is on the page.

That is also why 25 TAC §300.301(d)(12) asks for three values rather than one: delta-9 THC, total delta-9 THC, and total THC per container. A certificate missing any of the three is non-passing on the field set alone, before anyone reaches the arithmetic.

Route two: the scheduling action, and what we have not confirmed

The second route runs through a Texas controlled-substance scheduling change covering manufactured and synthesized cannabinoids, published in the Texas Register at 51 TexReg 4597 on July 10, 2026 with an effective date of July 31, 2026.

Here is what our record says about it, in full: we have named it, and we have not finished verifying it. The primary-source deep link is still outstanding, and the record does not decide which products and processes fall inside "manufactured" or "synthesized." That scope question is left open on purpose.

You will find retailer-facing pages this week stating flatly that THCA flower is a Schedule I controlled substance in Texas as of July 31. We are not going to repeat that, and not because we think it is wrong. We have not confirmed it, and the specific thing we have not confirmed — whether a naturally occurring cannabinoid falls inside a scheduling action written around manufacture and synthesis — is the exact hinge the whole claim turns on.

A confident answer to an unresolved scope question is worth less to you than an acknowledged gap, because you cannot tell from the tone of the page which one you are reading.

Why the two routes are being merged this week

On August 20, a petition was filed in the 459th Judicial District Court of Travis County against the Department of State Health Services and named officials, challenging what it describes as a post-July implementation and enforcement standard reaching naturally occurring cannabinoids such as THCA above trace amounts. The same petition contests the fee schedule and argues the policies conflict with the statutory hemp definition. A temporary restraining order and a temporary injunction are sought.

That is reporting, and it is presented here as reporting. We have not pulled the court record, no ruling has been reported, and this page does not tell you how it will come out.

What the filing does illustrate is the shape of the disagreement. The dispute is not about the arithmetic. Nobody is arguing about 0.877. The dispute is about scope — which cannabinoids a rule written one way reaches, and who gets to decide that. Those are different arguments, and the first one is not in play.

Where we stand on enforcement

We do not state that the total delta-9 THC threshold is presently being enforced, and we do not state that it is not. Our record carries enforcement posture as under review and asserts it in neither direction, and it has done so since before this filing. A lawsuit being filed does not settle a question; it is the mechanism by which an unsettled question gets argued.

Anyone telling you today what the enforcement posture will be in October is telling you a forecast. It may even be a good one. It is not a citation.

What is worth doing this morning

Pick one certificate off the shelf and check whether it reports all three values — delta-9 THC, total delta-9 THC, and total THC per container.

That check is worth doing precisely because it does not depend on how the scope question resolves. Whichever way the scheduling argument lands, a certificate that cannot show the value the threshold binds is a certificate you cannot reason from. Fixing that is a conversation with your laboratory or your vendor, and it is available to you today without waiting for a court.
